ANN SCOTTO nee COXFORD was the wife of EDMUND SCOTTOW. They married in Aylsham Norfolk in 1785 . He was born in Colby Norfolk in 1748 . Edmund was mentioned on an 1801 invasion poster. He was to supply 1 waggon and 3 horses in order to remove infirm persons, women and children from Aylsham, should the French have invaded England. He was also to be in charge of the Drivers who were to remove sheep and other livestock. Nobody knows where they would have gone to should the worst have happened.

TRANSCRIPTION:

This is the last Will and Testament of me Ann SCOTTO of Aylesham in the County of Norfolk Widow. Made this day in the year of our Lord One Thousand Eight Hundred and Twenty Three. First I nominate and appoint John Wright CLOVER of Aylesham aforesaid Grocerand Draper and Daniel SIDNEY of Thurning in the said Couty, Farmer, to be executors of this my will.

And I hereby authorise and direct my said Executors and the survivors of them his executors or administrators as soon as conveniently may be after my decease and they or he in their or his discretion shall think fit to make sale sell and dispose of either by public auction or private contract and either together or in parcels all my Messuage or Farmhouse in which James WALTERS now dwells, with the Houses, Outhouses, Yards, Lands and Hereditaments in Aylesham aforesaid and Banningham and Towns adjoining in the said County now in the occupation of the said James WALTERS with the appurtenances.

And to Convey assure the same when sold unto the person or persons who shall agree to become the purchaser or purchasers therof, or to such other person or persons and in such manner as he she or they shall direct or appoint. And the monies to arise from such sale or sales I hereby order and direct to be placed out at interest on Government or Real Security in the names of my said Executors, or the ( the words "survivors or" are deleted) survivor of them or the executors or administrators of such survivor.

And I declare that my Executors and the survivor of them, his executors or administrators shall stand possessed thereof in first to pay the interest, when and as the same shall become due unto and into the proper hands of my sister Mary, the wife of Thomas LYNG during her natural life. The same not to be subject to the debts or control of her present or any future husband and her receipt alone to be a sufficient discharge for all or any such interest monies and after the decease of my
said sister. Then after (?) trust to pay such interest when and as the same shall become due unto the said Thoma LYNG and his assigns during his natural life, and after the decease of the survivor of them the said Thomas LYNG and Mary his wife. Trust and I hereby give and bequeath the said monies so to arise by sale of my above mentioned estate unto and to be equally divided amongst the nine persons after mentioned, or such of them as shall be living at the decease of the survivor of them the said Thomas LYNG and Mary his Wife (that is to say) Ann Wife of Benjamin JOHNSON, Thomas LYNG, William LYNG, Maria LYNG, Robert LYNG, Hannah the Wife of John STEED, and George LYNG ( seven children of the said Thomas LYNG and Mary Wife) and William BALDING son of Elizabeth BALDING deceased (who was one other of the children of the said Thomas LYNG and Mary his wife) and Amelia BESSIER daughter of Mary BESSIER deceased ( who was one other of the children of the said Thomas LYNG and Mary his Wife)

And I do declare that incase that any of them, my said Legatees shall depart this life before the several shares of the said Trust monies shall be payable leaving issue, then such issue shall be entitled to receive the share or shares which the person or respective persons so dying would have been entitled to receive if living. Such issue if more than one to take in equal proportions.

And if any of my said Legatees shall die before the said monies shall be payable without leaving issue, then the shares of any such so dying shall go and be paid to the survivor or survivors of them.

And I direct my said Executors and the survivor of them his Executors or Administrators to receive he rents and profits of my said Messuages Lands and Hereditaments hereinbefore directed to be sold, and pay and apply the same in such manner as the interest of the monies to arise by such sale are directed to be applied.

And I give and bequeath unto the said Ann JOHNSON, Maria LYNG and Hannah STEED all my wearing apparel to be equally divided between them, and unto each of them the said Maria LYNG and Hannah STEED six of my Silver Teaspoons.

And I give and bequeath the rest of my plate unto and to be equally divided amongst the said Ann Johnson, Thomas LYNG, William LYNGF, Maria LYNG, Robert LYNG, Hannah STEED and George LYNG.

And I give and bequeath unto Sarah the Wife of Matthew RAYNES the daughter of James WALTERS the sum of Nineteen Pounds and Nine Shillings.

And I give and bequeath unto each of the sons and the daughters of John FARROW and Elizabeth his Wife that is to say Edmund, James, Joseph, Benjamin, Adam and Christopher FARROW and Elizabeth the Wife of Robert BARNEY the sum of Ten pounds a piece. And direct the same shall be paid at the end of Twelve Calendar Months after my decease.

And I hereby authorize enpower and direct my said Executors and the survivor of them his Executors or Administrators as soon as conveniently may be after my decease to sell and dispose of either by public Auction or private contract all that my Messuage or Dwellinghouse in which I now dwell situtated in Aylesham aforesaid with the Houses Outhouses Yards and Appurtenances and to Convey and assure the same to the purchasor therof or as he shall appoint. And the money to arise from such sale of my last mentioned Messuage and Premises I direct shall be added to my personal Estate.

And I hereby direct my said executors as soon as may be after my decease to convert into money all my personal estate and effects not before specifically bequeathed, and after the payment of all my just debts the Legacies hereinbefore bequeathed to the said Sarah RAYNES and to the sons and Daughters of the said John FARROW and Elizabeth his Wife my funeral testamentary expences and the charges of my Executors in executing this my Will. I give and bequeath all the rest and residue of the monies arising from the Sale of my last mentioned Messuage and Premises and of all my ready monies effects and personal Estate whatsoever unto and to be equally divided amongst the said Ann the Wife of the said Benjamin JOHNSON, Maria LYNG, Hannah the wife of the said John STEED, Thomas LYNG, William LYNG, Robert LYNG, and George LYNG share and share alike.

And I do hereby declare that any receipt or receipts of my said Executors or the survivor of them or the executors or administrators of such survivor, shall be sufficient discharges to the purchaser of any part of my said real estates, and that any such purchaser shall not be answerable for the application of any such monies, but that my executors shall be accountable for such monies only as they or either of them shall actually receive. And that they and each of them shall be allowed to deduct and retain all reasonable costs charges expences in executing the trusts hereby in them reposed.

And I do hereby revoke all former and other Wills and Testamentary Dispositions by me at any time heretofore made, and declare this only to be my last Will and Testament. I in Witness whereof, I the said Ann SCOTTO the Testrix have to the two foregoing sheets of this my last Will and Testament contained in three sheets of paper set my hand and to this third and last sheet set my hand and affixed my seal this Twentieth Day of October in the Year of our Lord One Thousand Eight Hundred and Twenty Three.

CODICIL

It is my will and desire in consequence of the death of Ann JOHNSON the Wife of Benj'n JOHNSON that their daughter Ann JOHNSON should receive her late mothers share of the above named wearing apparel, which the said Ann JOHNSON Sen'r would have been entitled to at my decease.

In the Episcopal Consistorial Court of Norwich in the Goods of Ann SCOTTO deceased on the Eighth day of Febuary in the Year of our Lord One Thousand Eight Hundred and Forty Five, appeared personally Mary England of Aylsham in the County of Norfolk spinster and made oath that she is one of the subscribed witnesses to a certain Codicil to the last Will and Testament of Ann SCOTTO late of Aylesham aftersaid Widow deceased which Codicil bears date the Third day of December One Thousand Eight Hundred and Thirty Eight and is now hereunto annexed.

That on the said Third day of December the said Testatrix duly executed the said Codicil by signing her name at the foot or end thereof in the presence of this Deponent and of Elizabeth Mary Ann CLOVER the other subscribed witness thereto who was present at the same time. And this Deponent and the said Elizabeth Mary Ann CLOVER thereupon attested and subscribed the said Codicil in the presence of the said deceased. Signed-- Mary ENGLAND

The said Mary ENGLAND signed this Affidavit and was sworn to the truth thereof at Aylesham the Eighth day of Febuary 1845 before me Edmund T YATES Clerk Surrogate.

This Will with the Codicil to the same was proved at Aylesham on the Twenty Eighth of January and the Eighth day of February 1845 before the Rev'd Edmund Telfer Yates Clerk Surrogate duly appt'd of the worshipful Charles Evans A. M. Official Principal of the Episcopal Consistorial Court of Norwich lawfully constituted & was approved &c & admon of all and singular the goods &c of of the within named Ann Scottow the Testatrix deceased was on the Twelfth day of the said month of February duly granted to John Wright Clover the surviving Executor within named he being duly sworn &c saving &c --Testatrix died 2nd August 1844. Probate granted 12th. Ex'd with original Will by me signed by me-- E.BUTLER February 1845
